FootWave™ Insole Giveaway Terms and Conditions

1. Sponsor

The FootWave™ Insole Giveaway (“Giveaway”) is sponsored by FootMedical Inc. (“Sponsor”), with a mailing address at 112 Capitol Trail, Suite A, Newark, Delaware 19711.

2. Eligibility

The Giveaway is open only to legal residents of the United States who are at least 18 years old as of the date of entry. Employees of FootMedical Inc., its affiliates, subsidiaries, advertising, and promotion agencies, and their immediate family members (spouses, parents, siblings, and children) or household members are not eligible to participate in the Giveaway.

The Giveaway is void where prohibited by law. State-specific exclusions or regulations may apply in Florida, New York, and Rhode Island, where certain legal requirements for sweepstakes exist.

3. Agreement to Terms

By entering the Giveaway, participants agree to abide by these Terms and Conditions, and the decisions of the Sponsor, which are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. Giveaway Period

The Giveaway begins on November 1, 2024, at 12:00 AM EST and ends on December 31, 2024, at 11:59 PM EST (“Giveaway Period”). There will be a drawing at the end of each month during the Giveaway Period. The Sponsor reserves the right to extend the term of the Giveaway. All entries must be received during the Giveaway Period to be eligible.

5. How to Enter

To enter the Giveaway, participants must complete the following steps during the Giveaway Period:

  • Follow @footwaveus on Instagram (instagram.com/footwave.insoles) and Facebook (fb.com/footwave.insoles).
  • Like the official giveaway post on either platform.
  • Tag a friend who is a mother or mother-to-be in the comments of the giveaway post. Each tag counts as one entry, and participants may tag up to three friends for a maximum of three entries per person.

6. Prize

Three winners will each receive one pair of FootWave Maternity Insoles (Approximate Retail Value: $49 USD each). The prize is non-transferable, and no substitution will be made except at the Sponsor’s discretion. The Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize becomes unavailable for any reason.

7. Winner Selection and Notification

Three winners will be randomly selected from all eligible entries on the last day of each month during the Giveaway Period. Winners will be contacted via direct message on the social media platform through which they entered within 3 working days of the drawing.

8. Odds of Winning

The odds of winning depend on the number of eligible entries received during the Giveaway Period.

9. Publicity

By entering, participants agree to the Sponsor’s use of their name, likeness, and entry for promotional purposes in any media, worldwide, without further payment or consideration, except where prohibited by law.

10. Release

By participating, participants agree to release and hold harmless FootMedical Inc., its subsidiaries, affiliates, and their respective officers, directors, employees, and agents from any and all liability, loss, or damage incurred with respect to participation in the Giveaway or the awarding, receipt, possession, and/or use or misuse of any prize.

11. General Conditions

Sponsor reserves the right to cancel, suspend, or modify the Giveaway if any fraud, technical failure, or other factor beyond the Sponsor’s reasonable control impairs the integrity or proper functioning of the Giveaway, as determined by the Sponsor in its sole discretion. In such event, Sponsor reserves the right to select the winners from the eligible entries received up to the time of impairment. The Sponsor is not responsible for late, lost, damaged, or misdirected entries.

12. Disputes

This Giveaway is governed by the laws of the United States and the State of Delaware without respect to conflict of law doctrines. As a condition of participating in this Giveaway, participants agree that any disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Delaware.

13. Privacy

Any personal information collected from entrants will be used solely for the purpose of administering this Giveaway and in accordance with the Sponsor’s Privacy Policy available at Privacy Policy.
